On November 9, 2024, the Vietnamese government introduced Decree No. 147/2024/NĐ-CP. This decree establishes clear guidelines for managing Internet resources, aiming to enhance online safety and reliability in Vietnam and effective from December 25, 2024.
Responsibilities of Users
The decree clearly defines the responsibilities of organizations and individuals using Internet resources, including:
- Providing accurate registration information.
- Respecting the rights of others to foster a safer online environment.
Situation for Temporary Suspension
The decree specifies situations under may be temporarily suspended include::
- Law Enforcement Requests: Written request from an investigation agency or competent state agency to prevent domain use threatening national security or public safety.
- Enforcement of Decisions: Written requests to implement decisions that preventing and handling of administrative violations by a competent agency in information and communications or other specialized inspectors;
- Inaccurate Registration Information: Cases where registration details are incorrect, incomplete, domain name registration does not comply with management regulations on structure and registered users;
- Non-Payment of Fees: When the registrant of the Vietnamese domain “.vn” fails to pay the required maintenance fees.
Situation for Revocation:
Domain names may also be revoked under several circumstances, such as:
- Authority Decisions: Revocation based on decisions or rulings from authorities regarding disputes or mediation agreements as mandated by law.
- Ministerial Decisions: Following the Minister of Information and Communications’ directives to revoke domain names for national interests or when they do not align with Internet resource planning.
- Penalties for Violations: Enforcing penalties for administrative violations in information and communication regulations, including domain revocation and confiscation of exhibits and means of violation.
- Law Enforcement Actions: Acting on written requests from the investigation agency, law enforcement specified in Point a, Clause 13 of this Article to promptly prevent acts of using domain names that violate national security, social order and safety according to the provisions of law.
- Unpaid Maintenance Fees: Applying to the Vietnamese domain “.vn” if maintenance fees remain unpaid for over 30 days.
- Invalid Registrants: Handling cases where registration information is incorrect, the registrant cannot be identified, the domain name registrant does not update, supplement or complete the information; the domain name is registered in violation of management regulations on structure and registered users; the domain name subject is an organization or enterprise that has been dissolved, bankrupt, or no longer exists without a valid transfer of usage rights to another subject according to the provisions of law; the individual has passed away without a valid transfer of usage rights to another subject according to the provisions of law.
Encouraging Domain Name Use
A significant aspect of this decree is its encouragement for individuals and businesses to build an online presence.
- Vietnamese citizens aged 18 to 23 will receive priority and support when registering and maintain third-level domain names under “.id.vn” for free or at a reduced cost.
- Likewise with businesses and household businesses with a certificate of household business registration as per legal regulations.
